A 50MW solar development in North Yorkshire has been successful in an appeal against a refusal of the scheme by Hambleton District Council. The Council had argued that the development would impact the agricultural land, however the inspector noted that it would not result in the loss of agricultural land as it could still be used for other agricultural uses. Furthermore, current government schemes actually encourage farmers to take land out of production. The inspector also recognised the benefit of an immediate grid connection to the local substation, as well as the contribution to renewable energy goals and biodiversity net gain. Costs were awarded to the developer as the Council failed to provide relevant evidence to support their refusal.
